Website and Waitlist Terms

Effective August 31, 2026 · Private-alpha waitlist

Plain English: these short terms cover Overture’s public marketing site, waitlist and invite-code handoff. Joining the waitlist does not guarantee access. The private music application has separate terms presented when access is offered.

1. Operator and agreement

This site is operated by [production operator name required], operating as “Overture,” at [production contact address required]. By using the site or joining the waitlist, you agree to these Terms and the Website and Waitlist Privacy Notice.

2. Waitlist and invitations

The alpha is limited and invitation-only. Joining the waitlist does not promise admission, timing, product availability or any particular feature. Overture may choose the order and number of invitations, pause the waitlist, or remove fraudulent or abusive entries.

Member invite codes are personal, limited-use credentials. The public site only passes a code to the private application; the private application decides whether it is valid and may apply additional product terms before access.

3. Acceptable use

You may not use the site to break the law; submit another person’s email without permission; automate or flood submissions; probe, bypass or interfere with security or rate limits; introduce malicious code; impersonate another person; or misuse Overture’s names, designs or content.

4. Overture materials

Overture owns or licenses the site, software, design, text, logos, characters and other marketing materials. You may view the site for personal, informational use. No other licence is granted, and Overture’s proprietary assets may not be copied or reused without written permission.

5. Privacy and communications

The Website and Waitlist Privacy Notice explains how waitlist information is handled. By submitting an address, you ask Overture and its provider Clerk to send operational messages about the waitlist, approval or an invitation. These are not a promise of access. You may withdraw from the waitlist by contacting [production contact email required].

6. Third-party services

The site may rely on hosting, font, security and waitlist providers or link to a separately hosted private application. Those services may have their own terms and privacy notices. Overture is not responsible for an unrelated third-party site merely because the public page links to it.

7. Availability and changes

This is a founder-stage private alpha. The site, waitlist and planned product may change, fail, pause or end. Overture does not promise uninterrupted availability or a release date. We may update these Terms; the effective date identifies the current version.

8. Disclaimers and liability

To the maximum extent permitted by law, the public site and waitlist are provided “as is” and “as available,” without implied warranties. Overture is not liable for indirect, incidental, special, consequential or punitive damages arising from the public site or waitlist. Overture’s total liability relating to them will not exceed US$100. These limits do not apply where applicable law does not allow them.

9. Governing law and disputes

These Terms are governed by [governing law required], without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes relating to this site or waitlist must be brought in the state or federal courts located in [court venue required], and each party consents to those courts’ jurisdiction and venue.

10. Contact

Questions, privacy requests and rights complaints may be sent to [production contact email required].

Deployment gate: the source copy intentionally contains visible operator and jurisdiction placeholders. Production cannot build until the founder supplies the real facts and records a founder- or counsel-approved review reference.
